Judge James Rafferty brings vast and invaluable experience as a trial strategist, litigator, arbitrator, and mediator to Lauletta Birnbaum. In addition, Judge Rafferty is widely recognized for his expertise for managing highly demanding and complex multi-faceted legal matters.

Judge Rafferty served as a New Jersey Superior Court Judge for sixteen years across all divisions of the Court. In the last 12 years he was the Presiding Judge of the Chancery Court and handled all General Equity and Probate cases. He also served as the designated ″Mount Laurel″ judge and designated environmental judge for Vicinage 15. He offers unique insight into and understanding of a wide range of matters including civil and family cases, auto negligence, medical malpractice, product liability, probate cases, corporate and small business disputes, and mortgage foreclosure. As the designated environmental judge for Vicinage 15 he was involved in successfully resolving many complex coverage disputes and extensive multi-faceted clean-up operations, as well as presiding over numerous complex land use and commercial cases, including oppressed shareholder and partnership disputes.

In addition to his accomplishments as a trial judge, Judge Rafferty’s ability to justly mediate/arbitrate and bring often hotly-contested legal battles to equitable, amenable conclusions has been a hallmark of his career. Working with parties to settle their disputes prior to trial is not only more palatable, it also saves all involved time, money and resources as well.

Judge Rafferty is also an Adjunct Professor of Law at Widener University School of Law in Wilmington, Delaware, where he teaches Equity and Chancery Court Practice.

Prior Experience
Prior to appointment to the bench, Judge Rafferty was a Certified Civil Trial Attorney. His trial experience includes auto negligence, medical malpractice, and contract litigation. He has tried cases before the United States District Court, the United States Bankruptcy Court and the United States Court of Federal Claims. He also served as Solicitor for the Washington Township Planning Board and the Washington Township Municipal Utilities Authority. Additional experience includes numerous jury trials involving significant damages, appeals to the New Jersey Appellate Division and the New Jersey Supreme Court, trials of Worker’s Compensation cases, and Federal Court litigation.

Judge Rafferty has served on ICLE Panels for courses in chancery practice and probate practice, as well as business disputes. Additionally, he has lectured county bar associations in these areas.
