Our Energy and Environmental Law Practice provides comprehensive coverage of transactional and regulatory matters both within the United States and internationally. Our clients include companies engaged in the design and construction of power generation facilities and power generation component systems, both for nuclear and non-nuclear facilities; companies providing midstream services for the petroleum industry, including Marcellus Shale extraction; and manufacturing and distribution companies faced with a full range of regulatory issues, including environmental, energy, occupational safety & health, and transportation.

Our comprehensive approach allows us to offer clients advice on deal structuring, due diligence, drafting and negotiating transactional and financing agreements, regulatory strategy, applying for permits and licenses with regulatory agencies, and negotiating with agencies towards a desired result.

Our experience allows us to work with regulatory agencies—in a cooperative manner when possible, and an adversarial manner when necessary—but always approaching agencies with our trademark practical business approach.

Our experience includes:

  • Represented a major international designer and builder of nuclear power plants and nuclear power plant systems in the negotiation of a $300 million agreement to construct new facilities and operational systems at an existing nuclear facility in the southeastern United States
  • Negotiated and drafted agreements to assemble a consortium seeking U.S. Department of Energy (DOE) funding and support for the creation of a new type of nuclear reactor, which could revolutionize the nuclear power industry
  • Represented clients in administrative proceedings before the U.S. Environmental Protection Agency (EPA), the U.S. Department of Transportation (DOT), and the U.S. Federal Aviation Administration (FAA), regarding alleged violations of the Clean Air Act, Clean Water Act, Hazardous Materials Transportation Act and other statutes related to public health and the environment, achieving favorable resolutions for the client
  • Advised clients on compliance issues relating to public health, worker safety, and health and environmental matters, including regulatory issues arising from the U.S. Occupational Safety and Health Administration (OSHA), EPA, DOT, and their state counterparts.
  • Advised clients regarding investigation, cleanup, and remediation obligations for spills, releases, and discharges occurring both on their property and on adjoining properties, bringing cost-recovery actions in state and federal courts
