Prior Experience
Ken draws from his experience at the USPTO and works with clients to first identify potentially patentable features of an idea, then develops a patent application filing strategy. Once the application is filed, Ken negotiates with the patent office in an attempt to seek the broadest, most reasonable coverage he can get for his clients. If the Patent Examiners are not convinced, and the case warrants it, Ken has the capability to appeal that decision to the Board of Patent Appeals and Interferences as well as the Office of Petitions.
On the enforcement side, Ken has substantial patent litigation experience and often works as a part of the “technical” arm of the team. Ken has played a substantial role in all phases of major patent infringement litigation, from the pre-filing investigation and discovery phase, through motion practice, trial, and appeals.
Ken rounds out his practice by counseling clients and rendering opinions on patent validity, scope, and enforceability, as well as the right to use, register, and enforce trademarks. Ken’s overall approach is to help clients strategically acquire, manage, and exploit their intellectual property rights.
